1. Eligibility to Use the Services
To access or use The Foundry, you must be at least 18 years old or the age of legal majority in your jurisdiction. By agreeing to these terms, you confirm that you are legally capable of entering into a binding contract with us and that you will comply with all applicable laws.
The Services are not designed for children under the age of 13, and we do not knowingly collect personal information from anyone under 13.
2. Membership and Account Responsibilities
To access The Foundry’s services, you need to create an account by providing personal information such as your name, email address, and a password. You agree to provide accurate and up-to-date information when registering. You are responsible for maintaining the confidentiality of your account credentials, and for all activities that occur under your account.
You may not transfer or share your account with others. If you suspect unauthorized access to your account, you must notify us immediately.
3. Free and Paid Memberships
The Foundry offers both free and paid membership options. Free membership grants limited access to community discussions, select resources, and events. Paid membership offers premium features such as exclusive access to courses, summits, private Q&A sessions with notable creators, and additional tools to support your business growth.
By purchasing a paid membership, you agree to the subscription fees outlined during checkout. Paid memberships are billed on a quarterly or semi-annual basis, depending on the plan you choose. We will never alter your subscription fees without your express consent.
4. Payment and Billing
You agree to pay all fees associated with your subscription, as stated at the time of purchase. All payments are processed via third-party providers, including Stripe and PayPal. By submitting payment information, you authorize us to charge the applicable fees to your chosen payment method.
We reserve the right to modify our pricing at any time with 30 days’ notice. Any changes in pricing will apply to future billing periods, not the current subscription period.
5. Refund and Cancellation Policy
If you are not satisfied with your experience, we offer a full refund within the first 30 days of your initial payment. If you wish to cancel after the 30-day window, you may be eligible for a prorated refund based on the remaining portion of your subscription period. Refunds are not guaranteed for renewals or recurring payments unless requested within a reasonable time.
To cancel your membership, please log in to your account or contact us. Upon cancellation, your access to premium content will be revoked.
6. Affiliate Program
Our affiliate program allows members to promote The Foundry and earn recurring commissions on successful signups through their referral links. By participating in the affiliate program, you agree to abide by the rules and guidelines we set forth.
You must represent The Foundry accurately and fairly. Misleading marketing or false promises will result in removal from the program and forfeiture of earned commissions.
Affiliates are entitled to commissions as long as the referred members maintain active paid memberships. Commissions are calculated based on the membership fees and processed on a recurring basis.
7. Conduct and Community Guidelines
The Foundry is a space for collaboration, growth, and professional development. To ensure a productive environment for all members, we ask that you adhere to the following guidelines:
- Respect other members and their contributions. Harassment, abusive language, or insulting behavior will not be tolerated.
- Constructive criticism is encouraged, but spamming or unsolicited promotions are not allowed.
- Do not share personal information, either your own or others, without consent.
- No NSFW(“Not Safe For Work”) content or discussions of a non constructive political or religious nature. We aim to keep the focus on business and personal development.
- Unsolicited direct messages (DMs) are prohibited.
Violation of these guidelines may result in termination of your membership without refund.
8. Intellectual Property and Use of Content
All content, including courses, resources, and materials provided within The Foundry, is the intellectual property of Dynastus. You are granted a limited, non-transferable, non-exclusive license to use this content for personal use only. You may not reproduce, distribute, or resell any content without prior written permission.
Members are allowed to download content for personal use, but sharing it publicly or redistributing it is prohibited, except when sharing promotional snippets in line with our guidelines.
9. Termination of Membership
We reserve the right to revoke your membership at any time if you violate the terms outlined here. In cases of misconduct, harassment, or behavior that goes against our community standards, your membership may be terminated without notice, and you will not be eligible for a refund.
10. Limitation of Liability
The Foundry, Dynastus, and any affiliated parties will not be held liable for any direct, indirect, incidental, or consequential damages arising out of your use of the Services. We do not guarantee specific results from your membership, and participation is at your own risk.
11. Changes to These Terms
We may update these terms from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. You will be notified of any significant changes, and continued use of The Foundry after changes are made constitutes your acceptance of the new terms.
12. Governing Law
These terms will be governed and construed in accordance with the laws of New Zealand. Any disputes arising out of or related to these terms will be subject to the exclusive jurisdiction of the courts located in New Zealand.
